These Terms of Service ("Terms") are a legal agreement between you and Velatrix App Studio ("we", "us", or "our") governing your use of the FitScan AI app (the "App"). By downloading, creating an account, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Not Medical Advice

FitScan AI provides general wellness and informational content only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Calorie and macro targets and AI coaching are estimates for generally healthy adults and are not a substitute for advice from a physician, registered dietitian, or other qualified professional.

Consult a healthcare professional before starting any diet or exercise program — especially if you are pregnant or nursing, under 18, have or have had an eating disorder, or have any medical condition or take medication.
Stop using the App and seek help if tracking negatively affects your relationship with food.
Never disregard professional medical advice because of something in the App.

2. AI Accuracy Disclaimer

The App uses artificial intelligence to identify foods from photos and text, estimate portions, calories, and macronutrients, and generate coaching. AI output is probabilistic and may be inaccurate, particularly for mixed dishes, hidden ingredients, or unusual portions. You are responsible for verifying information you rely on. Do not rely on the App to detect allergens or to meet medical dietary requirements.

3. Accounts

Some features require an account, which you can create with an email and password or via Sign in with Apple or Google. You are responsible for keeping your credentials secure and for activity under your account. You must provide accurate information and be old enough to consent (at least 13, or the higher age required where you live). You may delete your account at any time from Profile → Delete Account.

4. Subscriptions & Payments

FitScan AI offers auto-renewing premium subscriptions (monthly and annual plans). Food logging, photo scan, barcode logging, and AI coaching require an active store-managed free trial or paid subscription. There is no permanent free plan. Eligible new subscribers may be offered a 7-day free trial; eligibility is confirmed by Apple before you pay. Purchases are processed entirely by Apple In-App Purchase. Prices and trial eligibility are shown before purchase.

The temporary free trial includes 10 AI Coach voice minutes in total. Premium includes 60 AI Coach voice minutes each month.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Manage or cancel anytime in your device's Settings → Apple ID → Subscriptions.
Refunds are handled by Apple at reportaproblem.apple.com.

5. Your Content

You retain rights to the content you submit (meals, photos, notes). You grant us a limited licence to process and store saved tracking content solely to provide the App's features to you. Photos are sent for analysis and are not saved to your FitScan food history, as described in the Privacy Policy). You are responsible for the content you submit and must have the right to submit it.

6. Acceptable Use

You agree not to:

Copy, modify, distribute, sell, lease, or reverse-engineer the App except as permitted by law;
Submit unlawful or infringing content, or attempt to misuse, overload, or gain unauthorised access to the App or its AI services;
Use the App's output to provide professional dietetic or medical services to others without appropriate qualifications.

7. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Your use of the App is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any injury or health outcome arising from reliance on calorie/macro estimates or AI coaching. Our total aggregate liability will not exceed the greater of the amount you paid us in the prior 12 months or USD $10.

9. Apple's Role

These Terms are between you and us, not Apple. Apple has no obligation to provide support for the App and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the App and delete your account at any time. Sections that by their nature should survive (including 1, 2, 5, 7, 8) survive termination.

11. Changes

We may update these Terms from time to time. The updated version will be posted here with a new date; continued use after changes take effect means you accept them.
